TERMS & CONDITIONS OF SALE

Payment

Coastal Pots and Planters does not offer payment terms.


Payment may be made by credit card or electronic funds transfer (EFT). Credit card payments may attract a surcharge.


Unless otherwise agreed in writing, full payment of the invoice is required prior to dispatch or collection of the Goods.


Title in the Goods does not pass to the Customer until payment of the invoice has been made in full, notwithstanding delivery or risk having passed.

Quotes & Orders

The order process commences with a detailed written quote specifying product details, colour selection, quantities, delivery address and invoicing details. The Customer must confirm acceptance of the quote in writing.

Quotes are valid for 14 days from the date of issue and may be subject to change due to factors outside the Supplier’s control, including but not limited to significant changes in freight costs, foreign exchange rates or raw material costs.

Quotes are not binding until accepted in writing by the Customer.


All quotes are inclusive of GST, unless otherwise stated.


All orders require a minimum deposit of 50%. Once the deposit has been received, the order will be placed and the Goods scheduled for manufacture.


An invoice showing the deposit paid and the balance payable prior to dispatch or collection will be issued. Estimated ready-to-ship or ready-to-pickup dates are provided as estimates only.


All deposits are non-refundable, and orders cannot be amended or cancelled once a deposit has been paid, as all Goods are imported and made to order.

Shipping, Delivery & Collection

All orders are supplied FOB Coastal Pots and Planters’ warehouse, located in Australia.
Delivery is arranged via third-party transport providers. Freight charges as quoted by the transport provider are invoiced to the Customer by Coastal Pots and Planters. Customer collection may be available by prior arrangement.


Where collection is agreed, Goods must be collected within three (3) business days of notification that the Goods are ready. Storage charges may apply after this period.


All freight quotes are based on commercial dock-to-dock delivery. Additional services including but not limited to tailgate or liftgate delivery, residential delivery, delivery appointments, white-glove services, construction site delivery, city-core access, waiting time, inside delivery or debris removal will incur additional charges payable by the Customer.


Delivery dates provided are estimates only and are subject to change. Delays caused by freight providers, port congestion, weather, labour issues or other events beyond the Supplier’s control are not grounds for cancellation or claims for damages.


The Customer must ensure all delivery access details are accurate at the time of quoting. Any changes or additional requirements requested at the delivery site are the responsibility of the Customer.


Risk in the Goods passes to the Customer upon dispatch from the Supplier or its nominated carrier.


Where the Supplier arranges freight, any claim is limited to the extent recoverable under the carrier’s insurance.

Missing or Damaged Goods


The Customer must inspect the Goods immediately upon delivery.


Any missing items, damage or defects must be reported in writing within 24 hours of delivery to admin@coastalpotsandplanters.com.au including a description and supporting photographs.


Failure to comply with this inspection and notification requirement may affect the Supplier’s ability to assess the claim and may result in the claim being declined, to the extent permitted by law.


If damaged Goods are accepted by the Customer, details of the damage must be clearly noted on the Proof of Delivery and signed at the time of delivery.


Minor scuffs or marks to external packaging that do not affect the Goods are not considered damage.

Returns


Coastal Pots and Planters does not accept returns for change of mind, as all Goods are imported and custom made.

Returns will only be accepted where the Goods are faulty, defective or do not conform to the agreed specifications, in accordance with Australian Consumer Law.

Warranty

Each planter carries a three (3) year warranty from the date of delivery.

The Supplier warrants to the original purchaser that the Goods are made from quality materials and workmanship and are free from manufacturing defects.

Planters are handmade from lightweight fibreglass materials. Variations in colour, finish or texture resulting from the hand-finished process are not considered defects.

At its sole discretion, the Supplier will repair, replace or provide a credit for the original purchase price of any Goods proven to be defective due to materials or workmanship.

The warranty does not cover, and will be void where damage results from:

•    Mishandling, misuse or abuse
•    Failure to follow handling, planting or care instructions
•    Unauthorised modifications
•    Incorrect installation or inadequate drainage
•    Chemical exposure, impact damage or accidents
•    Storage in wet, humid or water-logged conditions

Planters are finished with an automotive-grade paint offering UV resistance and durability. However, storing planters in wet or steamy cartons, standing water, or without adequate drainage may damage the finish and is not covered by warranty.

Handling and planting instructions are provided with each order and must be followed to ensure product longevity.

The Supplier will not be liable for labour, removal, reinstallation, freight or any other associated costs arising from a warranty claim to the extent permitted by law.

Installation & Use

Planters are not pre-drilled for drainage. Drainage holes must be drilled prior to outdoor installation.

Planters must not be stored in continuously wet environments, including within cartons stored outdoors or without drainage.

The Customer is responsible for ensuring structural suitability, load-bearing capacity, drainage and overflow management.

Coastal Pots and Planters does not provide engineering or installation advice unless expressly agreed in writing.

Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of that State.
